1. Agreement

By accessing or using MailSub.Site, you agree to these Terms of Service, our Acceptable Use Policy, and our Privacy Policy. If you are using the service for an organization, you represent that you have authority to bind that organization.

2. Eligibility and Accounts

You must be legally able to enter into a binding agreement and use the service only in compliance with applicable law. You are responsible for safeguarding your credentials, controlling access to your account, and ensuring your users act consistently with these terms.

3. The Service

MailSub.Site provides tools to manage subscriber lists, prepare campaigns, send outbound email, process unsubscribes and suppressions, and monitor service health and abuse signals. We may add, remove, or change features over time.

4. Customer Responsibilities

You agree that you will:

  • send only to recipients who have valid consent or another lawful basis that applies to the message and jurisdiction involved;
  • keep evidence of signup source, timing, notice, and consent where required;
  • provide accurate sender identity, reply information, and subject lines;
  • include a clear unsubscribe method in every marketing message and honor unsubscribe requests promptly;
  • maintain accurate lists and remove invalid, bounced, unsubscribed, or complained-about recipients from future mailings; and
  • comply with our Acceptable Use Policy and all applicable anti-spam, privacy, consumer protection, and communications laws.

5. Prohibited Uses

You may not use MailSub.Site to send or facilitate spam, phishing, malware, fraud, deceptive marketing, unlawful content, or mail sent to purchased, rented, scraped, harvested, or otherwise non-permissioned lists. The Acceptable Use Policy provides additional detail and is part of these terms.

6. Deliverability, Authentication, and Suppression

To protect recipients and the network, we may require domain authentication, suppression handling, bounce processing, rate limits, complaint-loop enrollment, and similar operational safeguards. We may refuse, throttle, defer, review, or block mail that does not satisfy technical or policy requirements.

7. Complaint Monitoring and Enforcement

MailSub.Site monitors abuse-related metrics, including spam complaint counts, complaint rates, bounce rates, authentication failures, and similar reputation indicators. We may issue warnings, impose sending limits, require remediation, suspend sending, or terminate accounts when those signals indicate abuse or unacceptable network risk.

Unless immediate action is needed to protect recipients or the service, we will generally try to provide notice and an opportunity to remediate. Immediate suspension or termination may occur for serious misconduct, including phishing, malware, identity forgery, illegal activity, or clearly non-permissioned list use.

8. Data and Privacy

As between the parties, you retain your rights in your customer and subscriber data. You grant us the limited rights needed to host, transmit, process, secure, and suppress that data in order to provide the service, comply with law, and protect the platform. Our data practices are described in the Privacy Policy.

9. Aggregate Statistics

We may create and use anonymous, aggregate statistics about the service, such as the number of active lists, number of subscribers, mail volume, complaint totals, or other non-recipient-identifying operational metrics. We will not use this section as permission to sell subscriber lists or recipient-level behavioral profiles.

10. Payment and Suspension

If the service includes paid plans, fees are due as described at the time of purchase unless otherwise agreed in writing. We may suspend or downgrade service for nonpayment after reasonable notice, except where immediate suspension is needed for abuse, fraud, or legal compliance.

11. Export and Deletion

Subject to legal retention, suppression obligations, and technical limits, we will aim to provide reasonable export access to your mailing data. We may retain suppression and abuse-prevention records as needed to avoid re-mailing recipients who opted out or complained.

12. Intellectual Property

The service, software, branding, and site content are owned by us or our licensors. These terms do not grant you ownership of the service or any underlying software.

13. Disclaimers

The service is provided on an “as is” and “as available” basis to the maximum extent permitted by law. We do not guarantee uninterrupted service, inbox placement, delivery rates, or compatibility with every mail provider or jurisdictional requirement.

14. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, goodwill, revenues, or data. Our total liability for claims arising out of or relating to the service will not exceed the amounts you paid us for the service during the twelve months before the event giving rise to the claim.

15. Indemnity

You will defend, indemnify, and hold us harmless from claims, damages, losses, liabilities, and expenses arising from your content, recipients, mailing practices, legal violations, or misuse of the service.

16. Termination

You may stop using the service at any time. We may suspend or terminate access for violations of these terms, network risk, abuse, fraud, legal requirements, or prolonged inactivity. Sections that should survive by their nature will survive termination, including payment obligations, liability limits, suppression obligations, and dispute provisions.

17. Changes to These Terms

We may update these terms from time to time. If a change materially affects your rights or obligations, we will provide notice by posting an updated version or by other reasonable means. Continued use after the effective date of revised terms constitutes acceptance.
